Attendees will learn about the construction litigation process, from service of a claim through resolution and the importance of client selection and project management to limit liability. This will include covering various contractual risk mitigation measures and the role of professional liability insurance.

Learning Objectives: Attendees will learn ~

How to effectively select clients and use key contract provisions to limit potential liability.

How to effectively manage projects from initial design through substantial completion to limit potential liability.

How contract provisions and effective project management and documentation can minimize exposure and help ensure that your Errors and Omissions policy will respond to claims.

How the litigation process in both State Court and binding Arbitration proceedings works, typically.

Presenters:

Lawrence A. Treglia, Jr. received his undergraduate degree from San Diego State University (BA, 1982), and his law degree from the University of the Pacific, McGeorge School of Law (JD, l986). His practice focuses on civil litigation with an emphasis on construction law, and on representing and counseling design professionals. He has received Martindale Hubbell's AV Preeminent, the highest possible rating in both legal ability and ethical standards.


Mark L. Armstrong attended law school at Penn States Dickinson School of Law where he had the opportunity to serve as a student clerk for the Honorable John E. Jones III, at the United States District Court for the Middle District of Pennsylvania.  Mark is a civil litigator whose practice focuses on business disputes, construction claims, and issues affecting design professionals.  Mark has represented numerous design professionals from before litigation begins with strategies regarding how to respond to pre-claim requests all the way through to presenting claims and defenses to jurors.
