ADA/Accessibility Program
Lawsuit Interpreting the ADA

The program will explore lawsuits based on varying interpretations of the Americans with Disabilities Act (ADA).  Knowing the legal pitfalls related to the ADA and claims at issue in ADA related lawsuits may aid architects in avoiding such suits. This interactive presentation should provide participants with the knowledge necessary to help better understand the ADA.


Learning Objectives

1.Understand the types of ADA suits commonly filed.
2.Discuss the triggers that lead to architects being named in ADA-related suits.
3.Explore means of protecting architects from ADA suits through contract documents.
4.Enhance communication with architects clients related to ADA issues.
5.Learn from the examples of other architects as demonstrated through legal case studies involving ADA issues.

Joshua A. Cohen, Esq.

Mr. Cohen is a corporate and trial attorney with Collins Collins Muir + Stewart where he has worked since 2006.  Mr. Cohen has extensive experience representing design professionals both in transactional and litigation matters, including defending architects sued for ADA issues which range from cases in which the ADA issues are minor defects in a long list of other construction defects, to litigation based entirely upon the existence of ADA barriers in new construction.  Mr. Cohen also has experience representing property owners sued by the disabled seeking to assert rights under Cal. Civil Code § 51, and 42 USC §12100 et seq. to equal treatment in public accommodations.

Michael C. Lubin, Esq.

Michael C. Lubin is a trial attorney at Collins Collins Muir + Stewart in the Orange County office.  His practice focuses on the representation of design professionals, businesses and public entities throughout California.  Michael also handles employment practices liability matters for clients.  In addition to other Orange County based professional groups, Michael has attended numerous AIAOC events and meetings, including most recently presenting on July 12, 2016 to members on design professional and mechanics lien requirements.
